Supporting Individuals Who Need Assistance with Decision-Making

Tri-County Community Action Program’s Guardianship Services provide support to adults who are unable to fully manage personal, medical, or financial decisions on their own due to age-related limitations, developmental disabilities, traumatic brain injury, or other medical or behavioral health conditions.

Our team works closely with the New Hampshire court system, healthcare providers, and family members to ensure that each individual receives the support they need while maintaining as much independence and dignity as possible.

Every guardianship arrangement is tailored to the individual. The level of support provided depends on the person’s needs and is designed to be the least restrictive option available while still protecting the individual’s well-being.

When Guardianship Services May Be Needed

Guardianship may be appropriate when an individual is unable to make or communicate important decisions related to their health, safety, or finances.

This may occur due to conditions such as:

• Age-related cognitive decline
• Developmental disabilities
• Behavioral health conditions
• Traumatic brain injury
• Other medical conditions affecting decision-making ability

In these situations, guardianship provides a structured and legally recognized way to ensure the individual receives the support and protection they need.

How Guardianship Services Work

Guardianship appointments are made through the Probate Court. When the court determines that an individual needs assistance with decision-making, Tri-County CAP’s Guardianship Services may be appointed to serve in a supportive role.

Once appointed, our team works to help ensure the individual’s health, safety, and financial stability. This may include coordinating care, managing benefits, assisting with financial matters, and helping ensure that important decisions are made in the individual’s best interest.

Guardianship Services also works collaboratively with families, healthcare providers, and community partners to support each person’s overall well-being.

A Range of Guardianship and Financial Support Services

Guardianship Services provides several types of support depending on the needs of the individual and the direction of the court. These services may include guardianship of the person, guardianship of the estate, representative payee services, trustee services, and other financial management supports.

Each role carries specific responsibilities designed to help ensure the individual’s needs are met while protecting their rights and resources.

The services listed below provide an overview of the different roles Guardianship Services may fulfill.

Guardianship of the Person

Manages personal, medical, and care-related decisions.

Guardianship of Estate

Handles finances, tangible property, and assets for a person who cannot manage these themselves.

Representative Payee

Appointed by the Social Security Administration to manage a person’s SSA or SSI benefits.

Trustee

Manages and protects assets and investments according to the specific guidelines of an individual’s trust.

DHHS Benefit Management

Manages public benefits received through the New Hampshire Department of Health and Human Services such as SNAP, TANF, Medicaid and/or Medicare.

Estate Accounting Services

Tracks and reports to the court how client funds are spent or utilized.
